In the beginning of the twenty-first century, almost all countries have adopted the democratic system, some of them are still struggling in the struggle against it. Human civilization has been striving for a welfare state for eternal freedom and security. At the advent of the twenty-first century, we were facing a crisis in matters of human rights and security in a materialistic and nationalist race. Therefore, organizations like the Human Rights Commission were established at the international and national level to protect human security and rights. Presently, strengthening the topic of defense of human rights is a reflection of natural justice and human interest.
A scholar named Johann Locke was born in England in the 17th century. He considered the right to life, liberty and property as a natural right. Natural rights are the means which man brings with him by nature and no one can give or take those rights. Johann Locke's concept of natural rights can be considered the basis of human rights. Just as Locke claims that these natural rights are very important for the survival of human personality and human development, there are some other rights that can be included in the list of human rights. Among these rights, the right to equality, the right to freedom from all forms of discrimination, the violation of any human right on the basis of caste, birth, caste etc. is also an essential part of human rights. The right to education, the right to respect personal dignity and the right to freedom of custody, the right to freedom from custody can only be included in human rights. There are many other rights that figure in the human rights list. In fact, those rights are human rights, which exist naturally in humans. In other words, the existence of these rights in the human personality makes the development of human personality and human life alive, and those rights are absolutely essential for the development of the human personality. These are commonly named human rights.
Every human has certain natural and constitutional rights for normal living, which are determined by mutual understanding and rules. Keeping this theme in mind, the United Nations Union Human Rights Commission was established in the year 1946-47 as a functional committee of the Economic and Social Council. Under this, the Universal Human Rights Declaration was given official recognition on 10 December 1948 by the United Nations General Assembly. After a long time, on 15 March 2006, the United Nations General Assembly passed a resolution to set up a new Human Rights Council. The old Commission was abolished on 16 June 2006 and a new Human Rights Council was formed. It is noteworthy that the new council is permanent and directly subordinate to the General Assembly. It will enable deep analysis of human rights violations anywhere and in any country. Its work will be guided by the principles of universalization, fairness, objectivity and creative international dialogue. It must submit its report to all agencies and bodies on time to prevent human rights violations in an administrative manner. It is known that India is a member country of the Human Rights Council.
Human rights means all those rights which are connected with the life, liberty, equality and dignity of the person. On October 12, 1993, after the implementation of the Human Rights Act on 28 September 1993 in the context of institutions like PUCL or PUDR, for the freedom and defense of the poor, illiterate and weaker sections of the society in our country. National Human Rights Commission was formed.
Part-three of the Indian Constitution is described as fundamental rights and enforceable by the courts, whose Indian Constitution not only protects, but also punishes those who violate it. In the present day, the way in which the environment of rights violation is seen in the country, the discussion on human rights and its related dimensions becomes important.
Although many countries around the world are working not only on human rights. All rights under human rights are those which provide basic facilities and freedom to a human being. There have also been instances of human rights abuses in the country in which the Human Rights Department has played a very good role. The commission receives thousands of complaints every year. Most of these are related to death in custody, rape during detention, disappearance of people, excesses of police, non-action, mistreatment of women, etc. The most effective intervention of the Human Rights Commission was in the investigation of the disappearance of youth in Punjab and the Gujarat riots. However, the Commission itself does not have the right to hear the case. It can recommend the government or court to prosecute based on its investigation. This Commission, striving for human interests and justice, has had a challenging journey so far. At the international level, the Commission was seen as a consultant only among the superpower nations and at times the Commission was silently indifferent when faced with dilemmas between various countries in the defense of human rights during armaments competition, border fights and minor wars. . In our country too, there has been no shortage of challenges in this matter.
Although the National Human Rights Commission of India is an autonomous legal body, it will be a big challenge if the powerful ruling party does not become a puppet in the future. There is also a danger of turning the Human Rights Commission into a mere consultative institution by the ruling party ignoring its human rights commission. Also, the scarcity of resources in the growing population, such as; Human Rights Commission's jurisdiction in cases of illiteracy, poverty, hunger, unemployment, farmers' distress, health problems, cyber crime and social media related incidents, consumer problems, rape and exploitation with women, violence incidents etc. It makes it difficult to increase boundaries as well. The Human Rights Commission has faced criticism from the people for the exemption of independent action by police and military force in matters related to nationalist ideology and religious violent incidents. Bypassing all criticism, an institution like the Human Rights Commission should be considered paramount in our populous nation today as the days of innocent people being seen in religious, communalism, caste violence are seen in the country. There have also been cases like mabeling, and there have been complaints of harassment of women by the police administration. Although our Human Rights Commission has emerged from time to time as a shield for human interest but in view of the present circumstances, the Human Rights Commission for the rights of human civilization has proved to be a milestone in its form in a fair, free and universal manner. In which our human civilization can prosper and prosper.
